Terms

Contractor / Website Designer/owner- Agata Business Services 

Client  - The person or entity that purchases Individual Custom Website Design Projects from Agata Business Services Shop 

​This Classic Custom Website Design Project Agreement is entered into as of date by and between Agata Business Services having its principal place of business located at Lima, Upper Street, Fleet, GU51 3PE Hampshire (the “Designer”) and "Client" who purchase invoiced  Classic Custom Website Design Project via Online Shop, both of whom agree to be bound by this Agreement.

​This Project is a project design special only for one company/ business owner and can not be resold or used by different businesses / Companies. 

Co-ownership: You will receive co-ownership of the design. Once the design is finished we will sign in you to role co-ownership to your website.

Scope of work: As stated in the product description

Client to provide:

• Communication IMPORTANT.

• Text and/or images as agreed.

​Confidentiality Covenants Terms
This Agreement shall commence on the effective date hereof and shall remain in effect until the earlier of the completion of all services called for hereunder to be performed by the Contractor.

Once you purchase a project it cannot be terminated. 

Loyalty Terms and Conditions 

​Agata Business Services as your Website Designer commit to be loyal to your brand and not use any of your material outside you website.

Independent Contractor Status

The parties agree that Contractor shall be an independent contractor and not an agent, employee, or representative of Client. Client shall have no right to direct or control the details of the Contractor’s work. Contractor shall not receive any fringe benefits or other perquisites that the Client may provide to its employees and Contractor agrees to be responsible for its own business overhead and costs of doing business and to furnish (or reimburse Client for) all tools and materials necessary to accomplish the services required of the Contractor pursuant to this Agreement, and shall incur all expenses associated with performance, except as expressly provided in Exhibits or amendments to this Agreement. Contractor shall be responsible for paying all taxes on payments received pursuant to this Agreement and that Client shall have no obligation to withhold taxes from service fees payable to the Contractor hereunder. Contractor hereby indemnifies and holds the customer harmless of any obligation that may be imposed on Client to pay in withholding taxes or similar items or resulting from Contractor's being determined not to be an independent contractor.

Governance and Jurisdiction

The laws Of England and Wales shall apply to this contract, for both contractor and client, and to all of the services and payments relating to this contract, for both governance and jurisdiction. In the event of a dispute, any or all points of dispute shall be communicated in English language.

Instalment Payment Policy

1. Scope
This Instalment Payment Policy (“Policy”) applies to all clients of Agata Business Services (“ABS”) who choose to pay for services via our instalment (subscription) option. By selecting instalments and completing your purchase, you confirm that you have read, understood, and agree to this Policy and our full Terms & Conditions. If you do not agree, you must either pay the full amount upfront or forgo the service.

2. Instalment Terms

• 0% Interest: All instalment plans carry zero per cent interest (0% APR).

• Fixed Schedule: Payments are automatically collected each billing cycle until the total fee is paid in full.

• Non-cancellable: Once you opt for instalments, you cannot pause, halt, or cancel future payments.

• Wix Plan Requirement: To use any instalment plan of six months, twelve months, or longer, you must purchase a minimum one-year Wix plan at checkout.

3. Service Delivery & Completion

• Work Timeline: ABS strives to complete each project within the quoted timeframe, though some projects may finish before the final instalment is paid.

• No Withholding of Deliverables: Deliverables will never be withheld pending final payment; you remain obligated to complete all instalments even if the work is delivered early.

4. Non-Payment Consequences

• Reminder Calls: If an instalment is missed, ABS will contact you to arrange payment.

• Access Suspension: Failure to pay within seven days of the due date will result in your website access being removed and the site taken temporarily offline until full payment is made.

• Legal Action: If payment remains outstanding after suspension, ABS reserves the right to pursue legal action to recover the debt.

5. Agreement & Acceptance
